Insurance fraud is one of the most threatening crimes to the US economy. According to the F.B.I., the insurance industry generates over $1trillion in premiums each year, and according to the Coalition Against Insurance Fraud, (C.A.I.F.), the estimated cost for insurance fraud exceeds $80 billion a year. Moreover, the National Insurance Crime Bureau (N.I.C.B.), estimates the average American household’s insurance premium raises more than $300 a year due to the overwhelming cost passed over to consumers from insurance fraud.

The three most common forms of medical insurance fraud are false claim filing, false personal injury claims, and excessive treatments. The insurance fraud may originate with the individual attempting to “fake” an injury in order to receive benefits, or the healthcare provider may be the liable party. In either case, medical insurance fraud is a crime that is punishable in most regions.

False or excessive claim filling occurs when a healthcare provider attempts to bill the insurance company for a service that was not actually performed. The provider may attempt to bill the insurance company for equipment and supplies that were not used, or which may be determined to be excessive given the nature of the service. This causes the claim to increase and can also cost the patient an additional fee.

Insurance fraud has become so common that insurance companies cannot afford to have employees investigate every claim for assurance of validity. Instead, many insurance companies use sophisticated software programs and computerized statistical analysis to determine which insurance claims to target for investigations. However, industry experts have claimed that automated methods of insurance claim analysis are not without fault and claim these tools should only be used to determine whether a further investigation for insurance fraud should be pursued.

As the nation focuses on health care costs, health care providers and billing services have come under ever closer scrutiny, resulting in a surge in criminal charges. Any health care provider accused of fraud must hire the best defense attorneys available or risk losing their business to ill-founded charges.

If you believe you may be under federal investigation for a Healthcare Fraud Case, it is critical that you hire a qualified criminal defense attorney right away. Do not risk having your rights violated by neglecting to retain a skilled, experienced criminal defense attorney.
The Houston, Texas law office of Kuniansky & Associates will work diligently to ensure your rights are protected.
